Terms & Conditions

These Terms and Conditions (“Terms”) govern your use of Zenomiq(the “Service”), a web-based gear-engineering platform operated by RD Motion d.o.o.(“we”, “us”, or “our”), with registered office at Vojkova cesta 63, 1000 Ljubljana, Slovenia. By accessing or using the Service you agree to these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By creating an account, signing in, or otherwise using the Service you confirm that you are at least 18 years old (or have your legal guardian’s consent), that you have the authority to enter into these Terms on behalf of yourself or any organisation you represent, and that you accept these Terms together with our Privacy Policy and Cookie Policy.

2. Description of Service

Zenomiq is a cloud-based engineering platform that provides:

• Calculation and validation of cylindrical gear pairs to ISO 6336, VDI 2736 and DIN 3990.
• AI-assisted optimisation of gear macrogeometry from design targets.
• Project- and calculation-management tools, 2D and 3D geometry export, and PDF reporting.
• Optional API access for programmatic use.

We may add, modify or discontinue features at any time. Material changes affecting paid users will be announced in advance where reasonably possible.

3. User Accounts

Certain features require an account. You may create an account with an email and password or with Google OAuth. You agree to:

• Provide accurate, current and complete registration information.
• Keep your credentials secure and not share them with third parties.
• Accept responsibility for all activities performed under your account.
• Notify us promptly at info@rdmotion.com of any unauthorised use.

4. Data Storage and Privacy

Cloud infrastructure. Your data is stored on Google Cloud Platform within the European Union. We apply industry-standard organisational and technical safeguards to protect it.

What we collect. Account information (name, email, optional company), the project and calculation data you create, basic usage analytics (only if you consent to analytics cookies), and technical data such as IP address, browser type and device information.

How we use it. To provide and maintain the Service, improve the user experience, send essential service notifications, and — only with your consent — measure aggregated usage. Full details are in our Privacy Policy.

5. Cookies and Tracking

We use a minimal set of cookies and local storage for session management, security and (optionally) aggregated analytics. You can accept, reject or customise non-essential cookies at any time from the consent banner or via the “Cookie settings” link in the footer. See our Cookie Policy for details.

6. Intellectual Property

Our content. The Service, including its software, engineering models, AI optimiser, user interface, documentation and branding, is owned by RD Motion d.o.o. and protected by intellectual property laws. You may not copy, modify, reverse-engineer, sublicense or otherwise commercially exploit any part of the Service except as expressly permitted by these Terms.

Your content. You retain ownership of the parameters, calculations, projects and files you create on the Service. By using the Service you grant us a limited, worldwide, non-exclusive licence to store, process and transmit your content strictly as needed to provide the Service to you.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to gain unauthorised access to any part of the Service or to other users’ accounts or data.
• Interfere with, disrupt or attempt to overload the Service.
• Use automated tools (scrapers, bots) to access the Service without our prior written permission.
• Reverse-engineer, decompile, or attempt to extract the source code, algorithms or models behind the Service.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. While we apply rigorous engineering practice:

• Calculation results, including AI-assisted optimisations, are engineering aids. They must be reviewed and validated by a qualified engineer before being used in production designs.
• We make no guarantee that the Service will be uninterrupted, error-free or that defects will be corrected within a specific timeframe.
• You are responsible for ensuring that any design derived from the Service is fit for its intended application, including safety margins required by your industry, jurisdiction or customer.

9. Limitation of Liability

To the maximum extent permitted by law, RD Motion d.o.o. shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, revenue, data, business opportunities or goodwill, arising out of or in connection with your use of the Service. Our aggregate liability for any direct damages arising under these Terms shall not exceed the fees you have paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim.

10. Data Retention and Deletion

We retain your account and content for as long as your account is active. You may request deletion of your account and associated data at any time by contacting info@rdmotion.com. Some data may be retained for a reasonable period to comply with legal obligations, resolve disputes, or enforce these Terms.

11. GDPR Compliance (EU Users)

If you are located in the European Economic Area, you have the following rights with respect to your personal data:

• Right of access to your personal data;
• Right to rectification of inaccurate data;
• Right to erasure (“right to be forgotten”);
• Right to restrict or object to processing;
• Right to data portability;
• Right to withdraw consent at any time, where processing is based on consent;
• Right to lodge a complaint with the Slovenian Information Commissioner (Informacijski pooblaščenec).

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced via in-app notification or email at least 14 days before they take effect. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

13. Termination

You may terminate your account at any time. We may suspend or terminate accounts that violate these Terms or that pose a security or legal risk. On termination, sections that by their nature should survive (intellectual property, disclaimers, limitation of liability, governing law) will continue to apply.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Slovenia. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Ljubljana, Slovenia.
